Waste Collection Harrow Terms & Conditions
These Terms and Conditions set out the basis on which we provide waste collection and related services in Harrow and surrounding areas. By placing a booking with us, you agree to be bound by these Terms and Conditions. Please read them carefully before confirming any service.
1. Definitions
In these Terms and Conditions, the following definitions apply:
Client means the person, business, or organisation requesting waste collection services.
Company means the waste collection service provider operating under these Terms and Conditions.
Service or Services means any waste, rubbish, recycling, clearance, or related collection activities provided by the Company.
Site means the address or location where the Services are to be carried out.
Contract means the agreement between the Client and the Company incorporating these Terms and Conditions and any confirmed booking details.
2. Scope of Services
The Company provides scheduled and ad hoc waste collection and clearance services for domestic, commercial, and other premises within Harrow and nearby areas. The specific scope of Services, including the type of waste, estimated volume or weight, and collection frequency, will be agreed at the time of booking and confirmed in writing, verbally, or by electronic communication.
The Company reserves the right to refuse collection of any waste that is not accurately described at the time of booking, that may pose a risk to health and safety, or that is prohibited by applicable waste regulations.
3. Booking Process
3.1 Booking Requests
Clients may request a booking for waste collection by telephone, email, online form, or any other method made available by the Company. The Client must provide accurate information, including but not limited to:
Full name or business name.
Contact details.
Collection address and access details.
Type of waste and approximate quantity or volume.
Preferred date and time window for collection.
3.2 Confirmation of Booking
A booking is only considered confirmed when the Company has provided confirmation to the Client, which may be by email, message, or verbal confirmation followed by written details. The Company may require a deposit or full payment in advance, and the booking may remain provisional until payment has been received.
3.3 Changes to Bookings
Any change to the date, time, address, or scope of the Service must be requested by the Client as early as possible. The Company will use reasonable efforts to accommodate such changes but does not guarantee availability. Changes may result in an adjustment to the quoted price.
4. Access and Site Requirements
The Client is responsible for ensuring safe and adequate access to the Site at the agreed date and time. This includes arranging any necessary parking permissions, entry codes, or access through third parties such as building managers or neighbours.
If the Company is unable to access the Site, or if access is unduly restricted or unsafe, the Company may refuse to carry out the Service and may charge a call-out or cancellation fee in accordance with these Terms and Conditions.
5. Waste Description and Restrictions
5.1 Accurate Description
The Client must provide an accurate and complete description of the waste to be collected. This includes identifying any hazardous or special waste and disclosing any items that require separate handling or permits.
5.2 Prohibited Waste
The Company does not collect certain types of waste unless specifically agreed in advance and in compliance with applicable regulations. Prohibited or restricted items may include, but are not limited to:
Asbestos and materials containing asbestos.
Clinical, medical, or biological waste.
Chemicals, solvents, oils, fuels, and similar liquids.
Pressurised containers, gas bottles, or cylinders.
Explosive, corrosive, or highly flammable materials.
Radioactive materials or equipment.
5.3 Right to Refuse
The Company reserves the right to refuse to handle or transport any waste that is incorrectly described, unsafe, illegal, or for which the Company does not hold the necessary licence or permit. If waste is refused on arrival due to non-compliance, a call-out or cancellation fee may still apply.
6. Pricing and Quotations
6.1 Quotations
Any quotation provided by the Company is based on the information supplied by the Client and is subject to change if the actual volume, weight, type of waste, or access conditions differ materially from those described at the time of booking.
6.2 Additional Charges
Additional charges may apply in the following circumstances:
Excess waste beyond the quoted amount.
Extra labour required, for example, for dismantling items, moving waste from upper floors, or clearing obstructed areas.
Waiting time where the team cannot start work due to delays caused by the Client or third parties.
Special handling or disposal fees required by law or by the relevant waste facility.
7. Payments and Invoicing
7.1 Payment Terms
Unless otherwise agreed in writing, payment is due immediately upon completion of the Service or in advance of the collection date. The Company may require partial or full payment at the time of booking.
7.2 Accepted Payment Methods
The Company may accept payment by card, bank transfer, or other methods notified to the Client. Cash may be accepted subject to limitations and prior agreement. The Company is not obliged to accept any particular payment method.
7.3 Late Payment
If payment is not received by the due date, the Company reserves the right to apply interest on the outstanding amount in accordance with applicable UK legislation. The Company may also suspend further Services until all overdue amounts are settled in full.
8. Cancellations and Amendments
8.1 Client Cancellations
The Client may cancel or reschedule a booking by giving notice to the Company. The following cancellation terms will normally apply:
More than 24 hours before the scheduled collection time: no cancellation fee, and any prepayment may be refunded or applied to a future booking.
Within 24 hours of the scheduled collection time: the Company may charge a cancellation fee of up to 50 percent of the quoted price.
On arrival or after the scheduled collection time, or in the event of no access: the Company may charge up to 100 percent of the quoted price.
8.2 Company Cancellations
If the Company must cancel or reschedule a booking due to circumstances beyond its reasonable control, including adverse weather, vehicle breakdowns, staff shortages, or regulatory constraints, the Client will be offered an alternative date or a refund of any prepaid amounts for the affected Service. The Company is not liable for any consequential loss arising from such cancellation or delay.
9. Client Obligations
The Client agrees to:
Provide accurate information about the waste and the Site.
Ensure all waste intended for collection is clearly identified and accessible.
Obtain any necessary permissions from landlords, neighbours, or local authorities.
Comply with all relevant laws and regulations relating to the waste being produced and handled.
10. Service Performance and Timeframes
The Company will use reasonable endeavours to perform the Services on the agreed date and within the agreed time window. However, all times are estimates and are not guaranteed unless expressly stated in writing. The Company is not liable for delays caused by traffic, weather, access issues, or other factors outside its reasonable control.
11. Liability and Limitations
11.1 General Liability
The Company will exercise reasonable skill and care in the performance of the Services. If the Company is found to be liable for any loss or damage arising from its Services, its liability will be limited to the amount paid by the Client for the specific Service giving rise to the claim, except where such limitation is not permitted by law.
11.2 Exclusions of Liability
The Company is not liable for:
Loss or damage arising from inaccurate information or instructions provided by the Client.
Loss of profits, loss of business, or any indirect or consequential losses.
Damage to items left within waste intended for disposal, where the Client has not clearly removed or identified them as items to be retained.
Damage to property or surfaces reasonably necessary to access or remove waste, provided reasonable care is taken.
11.3 Non-excludable Liability
Nothing in these Terms and Conditions limits or excludes the Companys liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under UK law.
12. Waste Handling and Environmental Compliance
The Company is committed to handling and disposing of waste in accordance with applicable UK waste management and environmental legislation. This includes the proper segregation, transport, treatment, and disposal of waste at authorised facilities.
The Client acknowledges that once waste has been collected and removed from the Site, it will be processed, recycled, or disposed of as appropriate under relevant waste regulations, and the Client has no further claim over the materials.
13. Hazardous and Special Waste
If the Service involves hazardous or special waste, such waste will only be handled where the Company has expressly agreed to do so and holds the necessary authorisations. Additional documentation, permits, and charges may apply. The Client must fully cooperate in providing all information required for lawful handling and disposal.
14. Complaints and Dispute Resolution
14.1 Complaints
If the Client is dissatisfied with any aspect of the Service, they should notify the Company as soon as possible, ideally within 48 hours of the collection. The Company will investigate the complaint and seek to resolve it promptly and fairly.
14.2 Dispute Resolution
If a dispute arises that cannot be resolved through informal discussions, the parties may consider mediation or another form of alternative dispute resolution before resorting to legal proceedings. This does not affect either partys right to bring a claim in the courts.
15. Data Protection and Privacy
The Company may collect and process personal data relating to the Client for the purposes of managing bookings, providing Services, handling payments, and complying with legal obligations. The Company will take reasonable steps to protect such data and will not share it with third parties except where necessary to provide the Services, process payments, or comply with the law.
16. Force Majeure
The Company is not liable for any failure or delay in performing its obligations under the Contract where such failure or delay results from events, circumstances, or causes beyond its reasonable control. This may include, but is not limited to, extreme weather, natural disasters, accidents, strikes, transport disruptions, or changes in law.
17. Amendments to Terms and Conditions
The Company may update or amend these Terms and Conditions from time to time. The version in force at the time of the Clients booking will apply to that specific Contract. Any significant changes may be notified to Clients where reasonably practicable.
18. Severability
If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable by a court or competent authority, that provision will be deemed severed from the remaining provisions, which will continue to be valid and enforceable.
19. Entire Agreement
These Terms and Conditions, together with any written or confirmed booking details, constitute the entire agreement between the Client and the Company in relation to the Services and supersede any prior discussions, correspondence, or representations relating to the subject matter.
20. Governing Law and Jurisdiction
These Terms and Conditions and any Contract between the Client and the Company are governed by and construed in accordance with the laws of England and Wales. Any dispute arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
By confirming a booking for waste collection or related services, the Client acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions.
